By law, an employer is no longer obligated to provide health insurance coverage to an employee’s spouse once the employee and spouse are divorced. However, through a federal law called COBRA, the employer may be obligated to provide the option for the spouse to continue coverage on his/her own, albeit at a significantly higher rate typically. A party to a divorce case is usually required to maintain his/her spouse on employer-provided insurance during the pendency of the divorce case unless the spouse has other insurance available already.
